Terms & Conditions

Article 1 – Definitions
  1. In these General Terms and Conditions, the following definitions shall apply:

Cruise Control Studios: the company offering studio facilities and related services to which these General Terms and Conditions apply.

Client: any natural person or legal entity entering into an agreement with Cruise Control Studios.

Booking: any reservation of a studio, room, engineer, producer, equipment or other service provided by Cruise Control Studios.

Studio: any recording, production, writing, mixing, mastering or other space made available by Cruise Control Studios.

Services: all services and facilities offered by Cruise Control Studios, including studio rental, technical support, recording, mixing, mastering, production and other music production-related services.

Article 2 – Applicability
  1. These General Terms and Conditions apply to all quotations, bookings, agreements and services of Cruise Control Studios.

  2. Any deviations from these General Terms and Conditions shall only be valid if agreed upon in writing with Cruise Control Studios.

  3. If a specific quotation, booking confirmation or agreement deviates from these General Terms and Conditions, the provisions of such quotation, booking confirmation or agreement shall prevail.

  4. By confirming a booking in writing or making use of the services of Cruise Control Studios, the Client declares that they have read and accepted these General Terms and Conditions.

Article 3 – Quotations and Bookings
  1. All quotations issued by Cruise Control Studios are non-binding unless expressly stated otherwise in writing.

  2. A quotation shall remain valid for the validity period stated in the quotation.

  3. A studio reservation shall only become final once Cruise Control Studios has confirmed the booking in writing and, where applicable, has received the agreed deposit or advance payment.

  4. The availability of studios, personnel and equipment shall at all times remain subject to availability until the booking has been definitively confirmed.

  5. Changes to an already confirmed booking are only possible in consultation with Cruise Control Studios and subject to availability.

Article 4 – Rates and Payment
  1. All stated rates are exclusive of VAT unless expressly stated otherwise.

  2. The Client is required to pay invoices within the payment term stated on the invoice.

  3. Cruise Control Studios may require a booking to be paid in full or in part in advance.

  4. If a deposit has been agreed upon, the booking shall only become final once this deposit has been received, unless otherwise agreed in writing.

  5. The remaining amount must be paid no later than the agreed payment date and, in any event, before the start of the session, unless otherwise agreed in writing.

  6. Additional hours, additional services, equipment or other costs incurred during a session may be invoiced separately afterwards.

  7. A transaction surcharge may apply to credit card payments. The amount of such surcharge will be communicated to the Client in advance.

  8. Any transaction fees associated with international bank transfers shall be borne by the Client.

  9. If the Client fails to make payment on time, Cruise Control Studios reserves the right to suspend or cancel the booking and to charge statutory interest and any collection costs, insofar as permitted by law.

Article 5 – Cancellation
  1. The following cancellation terms apply to regular individual studio bookings:

    a. If a booking is cancelled more than 48 hours before the start of the session, the Client shall receive a full refund of any amounts already paid.

    b. If a booking is cancelled less than 48 hours but more than 24 hours before the start of the session, the Client shall receive a 50% refund of any amounts already paid. If the booking has not yet been paid, 50% of the agreed amount shall remain payable.

    c. If a booking is cancelled less than 24 hours before the start of the session, no refund shall be provided. If the booking has not yet been paid, the full agreed amount shall remain payable.

  2. The time at which Cruise Control Studios receives the written cancellation shall be considered the effective time of cancellation.

  3. Failure to attend a confirmed booking without prior cancellation shall be considered a cancellation made within 24 hours before the start of the session. In such case, the full booking amount shall remain payable.

  4. Different cancellation terms may apply to large-scale bookings, multi-day bookings, exclusive studio bookings, writing camps, events or other projects. Where applicable, these terms will be stated separately in the quotation, agreement or booking confirmation.

  5. If different cancellation terms have been agreed in writing for a specific booking, those terms shall prevail over the standard terms set out in this Article.

Article 6 – Studio Time and Overtime
  1. The reserved studio time shall begin and end at the times stated in the booking confirmation.

  2. Set-up, preparation, installation, soundcheck, saving or exporting files and breakdown shall take place within the booked studio time, unless otherwise agreed in writing.

  3. If a session exceeds the booked time, the additional time used shall be invoiced separately at the rate applicable at that time.

  4. Overtime is only possible subject to availability and with the approval of Cruise Control Studios.

  5. If the Client arrives later than the agreed starting time, this shall not entitle the Client to an extension of the session or a reduction of the amount payable.

Article 7 – Engineers, Producers and Other Professionals
  1. Recording engineers and other professionals may, subject to availability, be booked through Cruise Control Studios.

  2. Unless otherwise agreed in writing, the engineer's rate covers technical recording and studio services only.

  3. If an engineer, producer, songwriter, musician or other professional performs creative work, additional fees and/or arrangements concerning royalties, copyrights, neighbouring rights, master rights or other rights may apply.

  4. Such arrangements must be agreed separately with the relevant parties and do not automatically form part of the studio rental.

  5. Cruise Control Studios shall not be bound by arrangements made directly between the Client and external professionals unless Cruise Control Studios is expressly a party to such arrangements.

Article 8 – Use of the Studio and Equipment
  1. The Client shall handle the studio, equipment, instruments, furniture and other property of Cruise Control Studios with due care.

  2. Equipment and instruments may only be used for the purposes for which they are reasonably intended.

  3. The Client shall be responsible for damage culpably caused by the Client or by persons present under the Client's responsibility or at the Client's invitation.

  4. Any damage must be reported immediately to a member of Cruise Control Studios staff.

  5. Moving, connecting, disconnecting or modifying fixed studio equipment without permission is prohibited.

  6. Property belonging to Cruise Control Studios may only be removed from the premises with prior written permission.

Article 9 – Client Equipment and Personal Property
  1. The use and storage of equipment, instruments and other property brought onto the premises by the Client or their guests shall be at their own risk.

  2. Cruise Control Studios shall not be liable for loss, theft or damage to personal property, unless such liability cannot be excluded under mandatory law.

  3. Property left behind after a session may be stored for a reasonable period. Cruise Control Studios is under no obligation to retain abandoned or forgotten property indefinitely.

Article 10 – Files, Recordings and Backups
  1. The Client is responsible for securing and retaining audio files, project files, stems, sessions, masters and other digital files.

  2. Cruise Control Studios may temporarily retain files but does not guarantee that files will remain available after completion of a session or project.

  3. The Client is advised to make a complete backup at the end of each session.

  4. To the extent permitted by law, Cruise Control Studios shall not be liable for the loss, corruption or unusability of files resulting from technical failures, defective storage media, software issues or other circumstances reasonably beyond its control.

  5. If Cruise Control Studios archives or stores files at the Client's request, additional terms and charges may apply.

Article 11 – Intellectual Property and Rights
  1. Renting a studio or purchasing technical services does not, in itself, grant Cruise Control Studios any claim to copyrights, publishing rights, master rights or royalties relating to works or recordings created during the session.

  2. If Cruise Control Studios, Swiss Songs Publishing, an affiliated party of Cruise Control Studios, or a songwriter, producer or other rights holder represented by them is creatively involved in a project, separate arrangements may be made concerning rights, royalties, publishing, co-publishing, master rights or other compensation.

  3. Such rights shall arise only insofar as they have been separately agreed or arise directly from the rights of the relevant creator or rights holder.

  4. The Client is responsible for obtaining any necessary permissions for the use of copyrighted material, samples, beats, compositions, lyrics, recordings and other works used by the Client in the studio.

Article 12 – Conduct, Substance Use and Use of the Studio
  1. The Client is responsible for the conduct of all persons who gain access to the studio in connection with their booking.

  2. Instructions given by Cruise Control Studios staff regarding safety, equipment and use of the premises must be followed.

​

Smoking

  1. Smoking is not permitted in the studios or any other indoor areas of Cruise Control Studios. A designated smoking area is available at the rear of the premises. Clients and their guests must use this designated area exclusively.

​

Alcohol and Drugs

  1. The consumption of alcohol and soft drugs is permitted only in moderation, provided that such use is responsible and does not cause nuisance, unsafe situations, damage or disruption to the work being carried out.

  2. Excessive consumption of alcohol or soft drugs is not permitted. Cruise Control Studios reserves the right to prohibit further consumption or use and, where necessary, to deny individuals access to the studio or terminate the session.

  3. The possession, use, supply or sale of hard drugs is prohibited in and around the premises of Cruise Control Studios.

Cleanliness and Cleaning

  1. The Client shall leave the studio and communal areas used during the booking in a reasonably clean and tidy condition.

  2. If a studio or other area is left excessively dirty and additional cleaning is required, Cruise Control Studios reserves the right to charge the Client the reasonable additional cleaning costs incurred.

Food and Drinks

  1. Food and drinks may be consumed in the studios, provided that the areas used are left clean and tidy afterwards. Cruise Control Studios recommends consuming meals and other food items in the designated shared kitchen wherever possible.

  2. Placing or consuming drinks on or near desks, studio equipment, instruments or other electronic equipment is at the Client's own risk.

  3. If spilling or knocking over drinks causes damage to equipment, instruments, furniture or other property of Cruise Control Studios, and such damage is caused by the Client or by a person present under the Client's responsibility or at the Client's invitation, the reasonable costs of repair or, where repair is not reasonably possible, replacement shall be borne by the Client.

  4. The Client must immediately report any damage or spillage of liquids on or near equipment to a member of Cruise Control Studios staff so that further damage may be prevented where possible.

Conduct and Termination of Sessions

  1. Cruise Control Studios reserves the right to refuse individuals access to the premises or to terminate a session immediately in the event of dangerous, aggressive, intimidating, illegal or seriously disruptive behaviour, excessive substance use, or repeated failure to comply with staff instructions.

  2. Termination of a session pursuant to this Article shall, in principle, not entitle the Client to a refund of any amounts already paid.

Article 13 – External Persons and Guests
  1. The Client must notify Cruise Control Studios in advance if an unusually large number of persons, external professionals, film crews, photographers or other guests will be present during a booking.

  2. Cruise Control Studios may impose restrictions on the number of persons present for safety, capacity or operational reasons.

  3. The Client remains responsible for persons present at their invitation.

Article 14 – Liability
  1. Cruise Control Studios shall perform its services to the best of its ability and with the level of care that may reasonably be expected from a professional studio.

  2. Cruise Control Studios shall not be liable for indirect damage, consequential loss, loss of income, missed commercial opportunities or losses resulting from delays, insofar as such liability may legally be excluded.

  3. If Cruise Control Studios is liable for direct damage, such liability shall, to the extent permitted by law, be limited to the amount paid by the Client for the relevant booking or service, or to the amount paid out under Cruise Control Studios' liability insurance if such amount is higher.

  4. Limitations of liability shall not apply insofar as liability cannot be excluded or limited under mandatory law.

Article 15 – Technical Failures
  1. Cruise Control Studios shall endeavour to ensure that all booked facilities and equipment are operational and available.

  2. A technical defect affecting an individual piece of equipment shall not automatically entitle the Client to a refund if the session can reasonably continue using replacement equipment or a comparable solution.

  3. If a technical failure for which Cruise Control Studios is responsible makes it reasonably impossible to conduct the session, Cruise Control Studios shall consult with the Client to find an appropriate solution, such as replacement studio time or a refund for the portion of the service that could not be provided.

Article 16 – Force Majeure
  1. Cruise Control Studios shall not be required to fulfil its obligations if performance is reasonably impossible due to circumstances beyond its control.

  2. Such circumstances may include, among other things, fire, flooding, power or network outages, government measures, serious technical failures, illness or unexpected unavailability of essential personnel, and other circumstances over which Cruise Control Studios reasonably has no control.

  3. In the event of force majeure, the parties shall, where possible, attempt to reschedule the booking or agree upon another reasonable solution.

Article 17 – Privacy and Confidentiality
  1. Personal data shall be processed in accordance with applicable privacy legislation.

  2. Cruise Control Studios shall handle with due care any non-public information and unpublished material that can reasonably be understood to be confidential.

  3. If additional confidentiality is required for a project, the parties may enter into a separate non-disclosure agreement.

Article 18 – Governing Law and Disputes
  1. All agreements with Cruise Control Studios shall be governed by Dutch law.

  2. In the event of a dispute, the parties shall first attempt to resolve the matter through mutual consultation.

  3. If a dispute cannot be resolved through mutual consultation, it shall be submitted to the competent court in the Netherlands, subject to any applicable mandatory rules regarding jurisdiction.

Article 19 – Final Provisions
  1. If one or more provisions of these General Terms and Conditions are found to be void or unenforceable, the remaining provisions shall remain in full force and effect.

  2. Cruise Control Studios may amend these General Terms and Conditions from time to time. In principle, a booking shall be governed by the version provided to the Client at the time the relevant agreement was entered into.

  3. The most recent version of these General Terms and Conditions may be made available digitally by Cruise Control Studios.
